Agreement between EKAETTE and artisans (cleaners, electricians, plumbers and others) who take jobs through the app. Governing law: Nigeria.
Last updated 29 October 2026
1. Parties, definitions and status of the artisan
1.1 This Agreement is between EKAETTE DOTCOM LTD (RC 8387056) of 40, Jos Street, Garki, FCT, Nigeria ("EKAETTE") and the artisan accepting it in the EKAETTE app ("App") ("you" or the "Artisan").
1.2 In this Agreement: "Customer" means a person who books a Service through the App; "Job" means a booked Service; "Call-out Fee" means the fixed fee for attending and inspecting; "Quote" means the price you give a Customer after inspection; "Escrow" means EKAETTE’s holding of Customer payments until a Job is confirmed complete.
1.3 Independent contractor. Unless you have signed a separate contract of employment, you are an independent contractor. You are not an employee, partner or agent of EKAETTE. You may accept or decline Jobs offered to you, you provide your own tools, and you are responsible for your own taxes, pension contributions and insurance.
1.4 Employed artisans. If EKAETTE also employs you under a separate contract of employment, that contract governs your employment rights. This Agreement then governs your use of the App, the conduct of Customer Jobs, payment and liability. If the two conflict on employment rights, the contract of employment prevails.
1.5 EKAETTE connects Customers with Artisans, handles bookings and payments and resolves complaints. You carry out the work and are responsible for how it is performed.
2. Onboarding, vetting and standards of work
2.1 You may be accepted only after you provide and EKAETTE verifies: a valid government-issued ID (such as your NIN), proof of address, a guarantor, references, and evidence of your skills or a skills assessment.
2.2 Everything you give us must be true. False or misleading information is grounds for immediate termination. We may re-verify your details from time to time.
2.3 You will perform every Job with reasonable skill and care, in line with good trade practice and applicable law, and hold any licence or registration your trade requires (for example, for electrical work).
2.4 Your App account is personal to you. You must not share it or let another person do your Jobs.
2.5 You will carry ID, identify yourself to each Customer, and arrive with the tools and equipment needed for the Job.
3. Jobs, call-out fee and quotes
3.1 You will be offered Jobs through the App. Once you accept a Job, you must attend as agreed.
3.2 Punctuality. You must arrive within 30 minutes of the agreed arrival time. If you do not, EKAETTE will refund the Call-out Fee to the Customer, you will not receive any part of it, and repeated lateness or no-shows may lead to suspension.
3.3 The Call-out Fee is fixed at NGN 5,000. When you attend and inspect, you are entitled to the full amount.
3.4 After inspection, send the Customer a fair, itemised Quote through the App. The Quote is open to negotiation, and any agreed price must be recorded in the App.
3.5 Do not start work until the Customer accepts the Quote in the App. Extra work needs the Customer’s approval in the App first.
3.6 When the Job is finished, mark it complete in the App with photographs of the finished work. Payment is released only after both you and the Customer confirm completion.
4. Payment, escrow release and commission
4.1 Customers pay EKAETTE, which holds the money in Escrow. You must not take payment directly from a Customer unless EKAETTE has agreed in writing.
4.2 When you and the Customer have both confirmed that a Job is complete, EKAETTE will release your payment at the end of that week.
4.3 EKAETTE deducts a commission of 15% from each Job payment before release.
4.4 If the Customer raises a complaint, the disputed amount stays in Escrow until the complaint is resolved under clause 7.
4.5 Payments are made to the bank account on your profile. The account name must match the name on your ID.
4.6 EKAETTE may set off against your payments any refund, compensation or other amount you owe under this Agreement.
4.7 You are responsible for your own taxes. EKAETTE may deduct and pay over any withholding tax the law requires.
5. Liability, indemnity and insurance
5.1 You are directly liable to the Customer and to EKAETTE for damage to property, injury or other loss caused by your negligence, misconduct or defective work.
5.2 You will indemnify Customers and EKAETTE against all such loss, including reasonable costs EKAETTE incurs in compensating a Customer on your behalf.
5.3 EKAETTE does not hold insurance covering your work. You should have appropriate insurance yourself for the work you carry out.
5.4 EKAETTE gives Customers no workmanship warranty, but if the mediator decides your work was defective, you must put it right at your own cost or accept the resulting deduction from your payment.
5.5 Tell EKAETTE through the App within 24 hours of any accident, damage, injury or loss on a Job.
5.6 Nothing in this Agreement excludes liability that cannot lawfully be excluded, including EKAETTE’s own liability under any contract of employment you hold.
6. Conduct, safety and non-circumvention
6.1 You must be respectful and honest. You must not harass, discriminate against, threaten, steal from or mislead any Customer, or work under the influence of alcohol or drugs.
6.2 You must follow safe working practices, wear suitable protective equipment, and refuse any Job you reasonably believe to be unsafe or unlawful.
6.3 Treat Customers’ homes, vehicles and belongings with care. Take photographs only where needed to record the Job.
6.4 Non-circumvention. You must not encourage or accept work or payment from a Customer you met through the App outside the App, while this Agreement is in force and for 12 months afterwards. EKAETTE is not liable for any dealing outside the App. A breach may lead to suspension, termination, loss of pending payments to the extent of EKAETTE’s loss, and a fee of NGN 30,000, which the parties agree is a genuine estimate of that loss.
6.5 You must not subcontract a Job or send someone else without EKAETTE’s written consent.
7. Complaints, disputes and suspension
7.1 Complaints are raised with EKAETTE and addressed within 48 hours. You must respond to EKAETTE’s questions about a complaint within 24 hours and cooperate fully.
7.2 Where a complaint cannot be settled, EKAETTE’s mediator will review the evidence and decide an outcome, which may include rework, a refund, or release or return of Escrow.
7.3 You agree to be bound by the mediator’s decision on Customer disputes. This does not take away your right to go to a court of competent jurisdiction afterwards.
7.4 EKAETTE may suspend or remove you for serious or repeated complaints, low ratings, breach of this Agreement or safety concerns. Except where the matter is urgent, EKAETTE will tell you the reason and give you a chance to respond first.
8. Confidentiality and data protection
8.1 You may use a Customer’s personal data (name, address, phone number, photographs) only to do the Job. You must not copy it, share it, or contact the Customer for another purpose.
8.2 You must follow the Nigeria Data Protection Act 2023 and delete Customer data you hold once the Job is finished. Report any loss or leak of Customer data to EKAETTE within 24 hours.
8.3 EKAETTE collects and uses your own personal data as set out in its Privacy Notice.
9. Term, termination and general terms
9.1 This Agreement starts when you accept it and continues until ended.
9.2 Either party may end it on 14 days’ written notice. EKAETTE may end it immediately for fraud, serious misconduct, a safety risk, false information or breach of clause 6.4.
9.3 On termination you must finish or hand over live Jobs as EKAETTE directs. Payments for confirmed Jobs are released less any amounts owed to EKAETTE. Clauses 4.6, 5, 6.4, 7 and 8 continue after termination.
9.4 Governing law. This Agreement is governed by the laws of the Federal Republic of Nigeria in force from time to time that apply to services of this nature. The courts of the Federal Capital Territory (FCT) have jurisdiction, subject to clause 7.3.
9.5 EKAETTE may change this Agreement by notice in the App giving at least 14 days before the change takes effect. If you continue to use the App after that, you accept the change.
9.6 If any provision is invalid, the rest remains in force. A delay in enforcing a right is not a waiver. You may not assign this Agreement. This Agreement is the whole agreement between us about its subject.
Acceptance. By accepting this Agreement in the App, you confirm you have read and agree to it.
