Privacy Notice

1. Who we are and what this notice covers

1.1 EKAETTE DOTCOM LTD (RC 8387056) of 40, Jos Street, Garki, FCT, Nigeria ("EKAETTE", "we") is the data controller for personal data collected through the EKAETTE app and related services.

1.2 This notice applies to customers and artisans who use the App. Contact EKAETTE through the App with any privacy question, including to ask us to explain how your data is being used.

1.3 It is written to meet the Nigeria Data Protection Act 2023 ("NDPA").

2. Personal data we collect

Customers — Name, phone number, email, address and location of the job, booking and job history, photographs you upload, messages in the app, payment confirmation details (card details are handled by our payment provider and not stored by us), device and app usage data.

Artisans — Name, photo, phone number, address, government ID details (such as NIN), guarantor and reference details, skills and assessment results, bank account details for payouts, ratings and complaints, location while on a job.

2.2 We do not knowingly collect more data than we need. Where we run identity or background checks on artisans for safety, these are limited to what the vetting process requires.

3. Why we use it and our lawful basis

Create accounts, book jobs, match customers with artisans — Performance of a contract.

Take payments, hold escrow, pay artisans — Performance of a contract.

Vet artisans and keep customers and artisans safe — Legitimate interest and, where the law requires, legal obligation.

Handle complaints and mediation — Performance of a contract and legitimate interest.

Prevent fraud and misuse of the app — Legitimate interest.

Meet tax, accounting and regulatory duties — Legal obligation.

4. Who we share it with

4.1 We use your data for our business and never sell it. We share it only where necessary, with:

(a) the artisan assigned to your job (your name, address, phone number and job details), and the customer you serve if you are an artisan (your name, photo, rating);

(b) payment providers and banks that process payments, escrow and payouts;

(c) technology, hosting and communication providers who support the app, under written duties to protect the data;

(d) our mediator and professional advisers where needed to resolve a dispute or give advice;

(e) courts, regulators and law enforcement where the law requires or allows; and

(f) a buyer or successor of our business, who must keep to this notice.

5. Retention, security and transfers

5.1 We keep personal data only as long as needed for the purposes above and to meet legal requirements: personal data is kept for 6 months after your last activity on the App (for artisans, after the agreement ends), unless the law requires us to keep it longer or a complaint or dispute is still open. We then delete or anonymise it.

5.2 We use reasonable technical and organisational safeguards, such as access controls and secure storage, and limit access to staff who need it.

5.3 If your data is stored or processed outside Nigeria, we will do so only where the NDPA permits and appropriate safeguards exist.

5.4 If a breach is likely to risk your rights, we will notify the Nigeria Data Protection Commission within the legal time limit and tell you where required.

6. Your rights and how to complain

6.1 You have the right to: be informed about how we use your data; access it; correct it; ask us to delete or restrict it; object to its use, including for marketing; receive it in a portable form; withdraw consent at any time; and not be subject to a decision based solely on automated processing that significantly affects you.

6.2 To use these rights, or to have us explain how your data is being used, contact EKAETTE through the App. We will respond within one month, or tell you why we need longer. We may need to verify your identity.

6.3 If you are unhappy with how we handle your data, you may complain to the Nigeria Data Protection Commission.

6.4 We may update this notice and will tell you about material changes in the app.
